These Terms & Conditions (“Terms”) govern your use of the Notepad Android application (“App”). By downloading, installing, or using the App from Google Play or otherwise, you agree to these Terms. If you do not agree, do not use the App.

These Terms are designed to be consistent with Google Play Developer Program policies, including requirements for accurate app behavior, ads disclosure, and lawful use. They do not replace Google Play’s own terms between you and Google.

1. The App

Notepad provides note-taking features such as text notes, checklists, search, favorites, archive, trash, labels, themes, optional biometric lock for notes, and related organization tools. The App may also display advertisements and promotional content.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, solely for personal, non-commercial purposes, and subject to these Terms and Google Play’s terms.

You may not:

  • Copy, modify, distribute, sell, lease, or reverse engineer the App except where applicable law prohibits this restriction
  • Bypass security, ads, or technical limitations
  • Use the App for unlawful, harmful, or abusive purposes
  • Misrepresent the App’s source or remove proprietary notices

3. Accounts

The App does not require creating an in-App account. Google Play account terms still apply to download and purchases (if any).

4. Your content

You retain ownership of the notes and other content you create in the App (“Your Content”). You are solely responsible for Your Content, including its legality, accuracy, and backup. The App stores Your Content on your device for App functionality; we do not claim ownership of Your Content.

You agree not to use the App to store or share content that is illegal, infringing, or that you do not have rights to use.

5. Permissions and device features

The App uses Android permissions necessary for its features, including Internet/network access for ads and Google services, and biometric permissions to unlock notes you choose to lock (when available on your device). The App does not use foreground services. You can manage many permissions in system settings; denying required permissions may limit functionality (for example locked notes may be unavailable without biometrics or a device fallback).

6. Notes, backups, and reliability

We aim for a reliable notepad experience, but device storage limits, OS updates, OEM restrictions, force-stop/clear-data actions, and permission denials can affect how notes are saved or restored. Do not rely on the App as the sole record for medical, legal, financial, emergency, or other critical information without your own independent backup.

7. Advertising

The App is ad-supported and uses Google AdMob (banner, interstitial, app-open, and/or native formats) and may open advertiser websites. Ads may be personalized based on your device/Google settings. Fallback promotional cards may appear if an ad fails to load. You agree that ads are part of the App experience unless we offer a separate paid ad-free version (if any).

You must not click ads fraudulently, incentivize invalid clicks, or interfere with ad serving. Doing so may result in termination of access and reporting to ad networks.

8. Third-party services and links

The App relies on third-party services including Google Play services, Google AdMob, and Google Firebase (Analytics, Crashlytics, Realtime Database, and related libraries). Those services are governed by their own terms and privacy policies. We are not responsible for third-party websites opened from ads or links.

9. Privacy

Our collection and use of information is described in the Privacy Policy. By using the App, you acknowledge that policy.

10. Intellectual property

The App, including its design, text, graphics, logos, and software (excluding third-party components and Your Content), is owned by the publisher or its licensors and protected by intellectual property laws. Third-party libraries and SDKs remain subject to their licenses.

11. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, free of harmful components, or that notes will never be lost.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, INCLUDING LOST OR CORRUPTED NOTES, AD CONTENT, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU PAID NOTHING.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

13. Indemnity

You agree to defend and indemnify the publisher from claims arising out of your misuse of the App, Your Content, violation of these Terms, or violation of law, except to the extent caused by our willful misconduct where such limitation is not allowed.

14. Acceptable use & Google Play compliance

You agree not to use the App in ways that violate Google Play policies or applicable law, including but not limited to:

  • Malware, spam, harassment, or deception
  • Unauthorized data scraping or interference with other users or services
  • Impersonation or trademark misuse
  • Any activity that could cause the App to be removed from Google Play or that generates invalid ad traffic

15. Updates and changes

We may update the App through Google Play. We may also modify these Terms. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.

16. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access if you breach these Terms or if required for legal, security, or policy reasons.

17. Governing law

Unless mandatory local consumer law provides otherwise, these Terms are governed by the laws of the publisher’s principal place of business, without regard to conflict-of-law rules. Courts in that jurisdiction shall have exclusive venue, subject to your non-waivable consumer rights.
